    Proposed Modifications to Right Whale Speed Rule

    NOAA Fisheries announced proposed changes to the North Atlantic right whale (Eubalaena glacialis) vessel speed rule to further reduce the likelihood of mortalities and serious injuries to endangered right whales from vessel collisions. NOAA Fisheries accepted public comment on the proposed rule until October 31, 2022, the public comment period is now closed. Comments are reviewed and generally posted in the order they were received and may be viewed here.
    NOAA Fisheries hosted three informational webinars in August regarding the Proposed Rule. A recording of the August 16, 2022 webinar can be found below.


    Right Whale Speed Rule Assessment

    In 2013, NOAA Fisheries committed to publish a report evaluating the conservation value and economic and navigational safety impacts of the 2008 North Atlantic right whale vessel speed regulations (50 CFR § 224.105). The report was finalized in June 2020 and evaluates four aspects of the right whale vessel speed rule: biological efficacy, mariner compliance, impacts to navigational safety, and economic cost to mariners. It also provides a detailed assessment of the rule’s effectiveness, and assesses general trends in vessel traffic characteristics within Seasonal Management Areas over time.


    NOAA Fisheries solicited public comment on the speed rule assessment. The comment period closed at the end of March 2021 and we are posting comments received for public reference.


    Vessel Speed Restrictions

    All vessels 65 feet (19.8 meters) or longer must travel at 10 knots or less in certain locations (called Seasonal Management Areas or SMAs) along the U.S. east coast at certain times of the year to reduce the threat of vessel collisions with endangered North Atlantic right whales. The purpose of this mandatory regulation is to reduce the likelihood of deaths and serious injuries to these endangered whales that result from collisions with vessels.Because vessels of all sizes can strike a whale, NOAA Fisheries also encourages vessels less than 65 feet in length to help protect right whales by slowing to 10 knots or less within active SMAs as well.

Courtesy Viking Yachts</figcaption></section>The National Oceanic and Atmospheric Administration has proposed a 10-knot, speed-restriction rule for vessels 35 feet to 65 feet length overall across a broad swath of water along the East Coast in an effort to reduce right whale mortality from vessel strikes. If the rule is implemented, the impact on cruisers, fishermen and more, from Florida to New England could be measurable.
    Timelines for these Seasonal Management Zones or SMAs would vary depending on location, but generally they’d be in effect starting in November and run until mid-April to late-June (see proposed SMA map), extending from coastal waters out to 100 nautical miles. NOAA says the effort is an expansion of an already-existing rule for vessels greater than 65 feet length overall.
    According to NOAA, there have been 12 lethal right whale vessel strikes since 2008. Of those, five of the vessels have measured less than 65 feet in length. NOAA claims the total right whale population is about 350 with around 100 of those being female, adding that while a population increase occurred between 1990 to 2010, there has been a reproductive decline over the past decade, noting that entanglement in fishing gear has also added to population decline.

    The proposed rule has created a strong reaction from the boating, fishing and boatbuilder community.
    In a press release, Viking Yachts president Pat Healey stated, “This would be a devastating regulatory mandate. Right whale vessel strikes have just not been an issue for our industry. This is a classic example of government overreach.”
    In a letter to NOAA about the proposed rule, Healey stated, “The health of the ocean and all its life is of paramount importance to our company and boat owners. However, we believe the magnitude of the proposed rule warrants careful consideration to ensure that a practical, enforceable and realistic plan is put forward to address the right whale population.”

    Viking claims that since 1998 there have been 24 known right whale vessel strikes across 10 states. Of those, eight were attributed to boats from 35 to 65 feet.
    According to the American Sportfishing Association, the odds of a vessel from 35 feet to 65 feet striking a right whale are less than one in a million.
    The International Game Fish Association stated on its website that the rule “would cripple America’s outdoor economy along the East Coast.”

    Unfortunately, it is boating news brought on by more "destroy America" policy.
    So yes, it belongs front and center.
    First it starts out with a small area off the N.E. coast. Then it moves inland .. south and west. Next thing you know, the whole country bans gas, diesel, LP gas, and we're stuck with wind, oars and battery's on the water. Much like the push without thinking that they are trying to do with our roads and highways.
    In a free market system, the cream will rise to the top. If the green-topia idea's are so good, they wouldn't need laws mandating them. Or hidden behind a false narrative like "save the whales" .
    Not the America i want to live in. I can think for myself ... and I'm pretty sure the whales will be around long after human population is extinct.

    First of all, the people who work for NOAA are lifers, they don't come and go with Admistrations, This is a group of conservationist with 20,000 signatures is trying to lower the length from over 65 feet to over 35 feet.of a exsisting law that is NOT enforced, over a period of two years 10 ships have been cited for speeding while over 11,000 commercial ships were speeding and tens of thousands private boats were speeding with only 10 boats getting a violation, man those are pretty good odds , But I agree this is over reach and shoud not be changed because you will find those with power to enforce to go after boaters he don't like, the commerical data is always being transfered because they have to have an AIS transponder, remember the law now states over 65 foot so we are talking commerical, so one the law is not being enforced and It is only seasonal from November 15 th to April the time the endangered wales do breeding, the area is only from the Jacksonville offshore to Massachusetts in the winter time.

    If Biden signs the proposed law change, then you can bring him into this but as now his hands are clean,
    but the thread states "Brandon" which to you means "tuck joe biden" who as of yet has nothing to do with this proposal and you all are having a hissy fit about something that will never effect you and is not being enforced, and as yet Joe has not made any changes and the time when you could have provided your imput has expired.
    If you are really concerned you need to email those in power, or just cry.

    You really need to get out more .. or at least get your copy and paste stats from a reliable source.

    10 knots in the Atlantic .. 100 miles offshore. It looks like you and joey have never crossed or trolled baits in the Gulfstream .. if you had, you'd see that at peak, the water is ripping a lot faster than 10 knots ..

    Lots of private yachts that are well over 65' that run up and down the Atlantic. So it's not just commercial fisherman or cargo ships ...
    BTW .. hasn't the Easter Bunny .. err .. FJB ruined .. shipping, trucking and the rail system enough already ...

    Doesn't it bother you that international waters start 12 miles out .. yet he want's to control speed limits 100 miles out ... It's 65 miles from the port of Palm Beach to the west end of the Bahamas. How do you think the Bahamian people are gonna like getting ticketed out to Grand Cay and the Abaco's ..

    And once again ... If they want to control every inch of the Atlantic .. 100 miles out. What do you think they are gonna do to the intercoastal and inland waters. ???

    Someday, the braindead left is gonna run out of other people's money to give away. Amazing business plan, choke the taxpayer's ability to earn a living .. while taking more and more .. just to give it away to worthless causes ..

    Brandons bunch wants to completely destroy anything they think they can and get away with it. Some people that are boaters might oppose it but they are probably not brandon voters so to heck with what they want. Just ram it thru and sort out all the broken laws and CG regs later. Just for starters, Large boats cannot maintain steerage at that slow of speed. Would be a maritime lawsuit of epic proportions.

    GLASGOW, Nov 2 (Reuters) - The United States joined Britain, France, Germany and the European Union on Tuesday in a multi-billion dollar partnership to help South Africa finance a quicker transition from coal, that will provide a model for other countries.
    British Prime Minister Boris Johnson told the United Nations COP26 meeting in Glasgow that the initiative was valued at $8.5 billion overall and would help move the world toward meeting its climate targets by "choking off international finance for coal".

    South Africa, which is the world's 12th biggest emitter of climate-warming gases and heavily reliant on ageing coal-fired power stations for its electricity, said the money would help it deliver on a more ambitious pledge to reduce emissions by 2030.

    He said the United States would provide financing to bolster global efforts to reach net zero emissions "by closing South Africa's coal plants ahead of schedule and investing in clean alternatives ... for the people of South Africa."
    President Cyril Ramaphosa said that the agreement marked a "watershed moment" for South Africa and the world, while von der Leyen that the "just energy transition partnership" could provide a blueprint for work with other countries.



    "It is proof that we can take ambitious climate action while increasing our energy security, creating jobs and harnessing new opportunities for investment, with support from developed countries," Ramaphosa said in a statement.
    Biden did not specify Washington's financial contribution, but underscored its commitment to follow through on pledges made by the Group of Seven advanced economies in June to accelerate the transition away from coal in developing countries.
    Germany said it would spend 700 million euros on the initiative.
    Coal is the most polluting fossil fuel, and phasing it out quickly is seen as crucial if the world is to meet the Paris Agreement's target to limit global warming to 1.5 C and avert the most catastrophic impacts of climate change.
    Many poorer countries say they cannot go further without funds from richer nations with historical responsibility for climate change, putting climate finance centre stage at COP26.
    Biden said the funding would ensure "equitable, inclusive transitions in South Africa's coal sector" by helping regions and workers in coal industries affected by the phaseout.
    More than 90,000 people were employed in coal mines alone in 2020 in South Africa, which pledged to cut emissions by 2030 in an updated contribution to global efforts.
    "A first of its kind agreement between a coal-intensive developing country and a group of donor governments to work together and fund a just transition away from coal. This is a big deal," Jesse Burton, an energy policy researcher focused on South Africa's coal sector, said on Twitter.
    South Africa said the money will help it to accelerate investment in renewable energy and the development of new sectors like electric vehicles and green hydrogen, and ensure state utility Eskom has access to funds to re-purpose coal-fired power stations due to be decommissioned in the next 15 years.
    Funds are also needed to ensure communities reliant on coal mining or coal power stations for jobs have greener alternatives to make a living as part of that process.
    John Morton, a former private equity adviser and top climate adviser to U.S. Treasury Secretary Janet Yellen, told reporters the initiative with South Africa underscored the importance of transitioning away from coal and could be a template for partnerships with other carbon-intensive economies.
    Mafalda Duarte, who heads the Climate Investment Funds (CIF), which has financed over 300 climate-friendly projects in some 72 countries, told Reuters her group had been working for months to develop the new Accelerating Coal Transition (ACT) facility, the first such instrument for developing countries.
    It will work through multilateral development bank partners to offer South Africa and other countries a financial toolkit combining low-cost loans with technical assistance, to help attract investment from the private sector and other sources.
