Pretty sure if the key is in ignition whether engine is running or not he is guilty. At least in MD this the law.

The answer is yes, the charges will hold up because even though he was stopped, he was in physical control of the vehicle. Field sobriety tests would then confirm that he was either intoxicated or not. I've even seen a DUI charge stick at .041977 Hydrostream Vector 2.5 Promax
