The answer is yes, the charges will hold up because even though he was stopped, he was in physical control of the vehicle. Field sobriety tests would then confirm that he was either intoxicated or not. I've even seen a DUI charge stick at .04

In Florida, you don't even need to be driving or on a roadway. If you're drunk, sleeping in your front seat in your driveway with the key in the ignition.... you go to jail.....
