I guess if you are hit by a boat with a propeller guard.....
......let's think about this for a minute, since the court has not. Let's assume these "propeller guards" could be made to work (which they can't). I guess that there must be no danger from the lower unit itself travelling through the water. Naw, you couldn't get killed by that, or the hull of the boat itself hitting you. It's only the prop that's the problem.

Here's the basic problem Ron. This country is becoming infected with not only liberals, but idiots. Many cases are decided when the jury is picked. The system is badly flawed for a number of reasons, but one major one is the fact that it's IMPOSSIBLE to truly get a jury "of ones peres" (spelling?) In this area the juries are picked in zip codes. Imagine having a complex civil matter before the court and the jury having a heavy percentage of welfare mothers who have never worked and never finished high school. This type jury is going to almost always rule against the "bad old corporation" who's taken advantage of people for years. It's this very mentality that's allowed these trial lawyers to get this mess to the point it now is.
Here's the scenario: You're Mr. John Q Ambulancechaser, Esquire (attorney) You're riding down the road thinking, "who can I shake down and extort a huge sum of money from, stealing a third of so of it for myself. Hmmmm, I heard these newfangled cell phones might be causing brain cancer, so I'll sue them." So you pick one and file a zillion dollar class action lawsuit on behalf of "undisclosed plaintiffs". Then you go into court and supeno (damn I can't spell anymore) all of the defendant's customer records and contact them and ask if they'd like to participate. You can even tell them that they're AUTOMATICALLY included unless they write back EXCLUDING themselves and will participate an any cash award. THIS IS HAPPENING EVERYDAY ALL ACROSS AMERICA and now they're even doing copycats with one attorney seeing what another's done successfully and finding a similar company to extort. Until we get some meaningful tort reform that MUST INCLUED LOOSER PAYS EVERYBODY'S ATTORNEY FEES AND ALL COURT COSTS, this insanity is going to continue.Membership upgrade options: http://www.screamandfly.com/payments.php

Actually, I see a BIG difference with Tobacco.
Before I get into it, I'll admit that I'm VERY biased against tobacco. It killed my father, my father in law, at least one of my grandfathers, and countless other relatives and friends. In my business, which is respiratory care at home, at all times we're furnishing home oxygen to several hundred smokers and ex smokers who are dying a slow death that's extremely stressful to them and devastating to their families.
For years the tobacco industry lied to the public about the addictive characteristics of tobacco as well as the medical risks. We're losing a whole age group of people now who got real hooked long before the health risks were disclosed, even though they were well known by the manufacturers. Until the government stopped the advertising, they were absolutely marketing to the younger people also, because the knew they were more likely to start than older people who never smoked.
I've seen a countless number of smokers who'll argue to the point of a fight about their right to smoke, but there's one thing I've never heard, not even once.........."I'm glad I smoke" or "I'm glad I started smoking".Membership upgrade options: http://www.screamandfly.com/payments.php

can i sue
my wife?? she is a respatory theripist[my spell checker just took a crap] and she smokes a pack a day or more. worked in the home care end for years and she saw all it did to a lot of people and she still continues to smoke! maybe i can sue her and win for all the non smokers of the world. hell maybe we can all join a class action suit for all the bad air we have to breathe.
think how much better ur boat would run without all the smoke in the air???

Lets see: I read this on Scream & Fly, ISP is AOL (Maybe they got a little money left) on an emachines computer with an AMD chip. Plus I drank a cup of Starbucks coffee made extra strong with lots of caffiene.
Good thing I believe I'm responsible for myself. Even responsible for smoking for most of 40 years when I knew it was bad for me. I could have quit. I might have had to get help but it was my choice.
