Crownline settles boat-crash lawsuit
Unfreagin believable! 14 people in a 22' boat, they T-bone a barge (!!!), sue the boat manufacturer and win! If y'all remember, I posted the story when the accident happened.
Lawyers for five victims of a fatal 2009 Easter boat crash in Palm Valley, Fla., settled their lawsuit against the boatbuilder.
Terms of the settlement are confidential, and lawyers for the plaintiffs and Crownline Boats declined to comment to The Florida Times-Union newspaper.
Three injured people and two representatives of deceased victims sued the boatbuilder in federal court shortly after the 2009 crash, arguing that the design of the Crownline 225BR was inherently unsafe.
The 22-foot pleasure boat struck a tugboat moored in the Intracoastal Waterway just north of the Palm Valley bridge, killing five people and injuring nine.
Maritime lawyer Rod Sullivan declined to comment, but he said when he filed one of the lawsuits that Crownline promoted the boat as being capable of safely transporting 12 people. That means five have to sit in the bow, forward of the boat's windscreen. State and federal maritime officials consider that unsafe, he said, because it subjects those passengers to ejection and blocks the driver's view, the newspaper reported.
Several victims were thrown from the boat into the side of the tug.
Although there were 14 people on the boat, Sullivan said that did not contribute to the accident. He said witnesses told him the boat driver's view was obstructed by passengers on the bow.

lawyers suck and more often than not seem to take the common sense out of life. I spoke with a barrister (attorney in the bahamas) while on business over there a few years ago. during the small talk we were discussing the differences bewteen our two countries and the laws/courts. he said something that really hit home. he said:
"yours is the only country that rewards people for stupidity."
as correct as he was, too often news reporters are either incapable of summarizing the facts correctly involving a law suit and rulings, or intentionally mislead people when they report on it because it makes a more sensational story. Eg, the McDonalds coffee spill story.
What ever the actual facts in front of the bench were, it sucks that people were killed, and that a business can be held responsible for the stupidity or negligence of the operator of a vessel.Last edited by Fish; 05-03-2011 at 12:32 PM.

I do remember you posting this before, man that just plain sucks, I can't believe a jury would award these idiots money, I like the quote Fish posted, these types of things really make me shake my head and wonder what we have done to ourselves!

And people wonder why the government is so ****ed up... It's run by lawyers.
Until we have REAL tort reform (kryptonite to ambulance chasers) things like this will continue to happen.

Tort reform would have so many positive effects on our country but since the whole thing is run by lawyers it'll probably never happen

I remember this being posted,its always a tragedy when someone dies,but wouldn't that be like one of us suing a car company because the windshield wipers won't keep up in a bad storm?? I feel sorry for the familys,but guess what if I couldnt see I would stand up!!

Majority of boating related accident causes come from one source. In-experienced or in-capable captain. Period!
How many of us understand and accept the responsibility we take on the minute a passenger steps aboard?? (now add speed, other boaters, questionable conditions, alcohol, equipment condition etc, etc, etc)
I remember yrs ago one of my best friends asking me that exact question when he, his wife and young children got onto my 28' cruiser on Lake Erie while preparing to go through Sunday rush hour traffic. A question and responsibility I haven't forgotten since.

OK--I'll make myself a target here. This was a settlement--but remember that those ridiculous verdicts we hear about come from juries--people just like us (but maybe the ones who couldn't get out of jury duty) who get all teary eyed and give millions to people for their stupidity, or that of their wives, husbands or parents.
If this theory is right, I guess no boat builder can manufacture a bowrider.Per Rock:
