Non Disclosure
If someone on this board is selling something ie boat, motor, etc., and knows that there is a defect or flaw, should he disclose this to the potential buyer, or should he not disclose it, and plead the fifth afterwards.
Than should he be held resposible for the problem, and most importantly what should you do if he does not want to cooperate?
A) Sue him
B) Beat him
C) Sink his boat21 Tuff, Mercury 300X

I am haveing a hard time understanding why you would even ask this question.
The obvious answer is to be forward and up front about any problems or defects in any item for sale.Obviously we cant all be cave men like Phast boat and give hospital tours in every city to all who you feel have wronged you.Rob Lankford

Well if Sam cracked as many skulls as he would lead us to beleive he would be in Prison and not Hanging out here.Yes I agree you should be pissed.I guess I missunderstould the actual question.Wait a minute no I didnt.I feel I answered your question.Should you tell when there is a problem to a potential customer?I say YES.
I take it you got burned.I dont know.It appears that way.Sorry you got screwed but giveing hospital tours is not the answer.

I agree with rob, the seller should always be up front, in our sport even more, because deceptive selling practices could get someone hurt....anyone who has spent even a small amount of time around what we do knows this, so in my opinion anyone intenionally misrepresenting a major item, i.e. boat, motor, PROPELLER, etc is not only a p.o.s. but a criminal as well.....

Personal I tell each person that buys something from me that if they dont like what they see when it arrives then they can ship it back the very next day or within a week and I will refund their money.

Sometimes when a person selling a USED part his or her opinion differs GREATLY from the another as to the condition of the part being sold ..I always tell a seller that IF the part doesn't meet with my approval and I can't use it I send it back the next day and eat the freight BOTH WAYS that way the seller with the parts is out NOTHING ! I have had GREAT success with no hard feelings from the seller if I send the part back so far. BUT IMO the seller needs to be objective with his apprasial and or condition HE feels the part is truely in... My scale is as follows a # 10 is NEW PART IN THE BOX SEAL UNBROKEN period...A 9 - 8 1/2 is a gently used part that one would have to look pretty hard to see any use... And below that most of the time I'll have to pass to be used on a customer's High Performance Engine...The problem is that most IMO are really NOT trying to screw another on this board ( And if you frequent this board you would be a complete FOOL to do so intentionally) , I would like to feel most sellers truely feel this part is as advertised and get thier feeling hurt when the buyer dissagrees. BUT each has thier own opinion as to whats "CHEERY" verses "I ain't putting that junk on or in my motor"..........
Good luck,Jay @ JSRE

Interesting
One thing I find a little odd is that most (but not all) of the motors for sale on this site are advertised one of two ways, fresh or blown. The fresh ones are almost always "just broke in". Given the cost of a good rebuild, it's nearly impossible to recover the money spent on the freshen up. Why would someone sell then...?
With no real way to verify engine hours, it makes me uncomfortable no matter the seller (not directed at anyone in particular)

I just bought a powerhead froma guy that just rebuilt it and it has around ten hours or more.He bought a new 300 because he wanted warranty and power along with reliability.I did the same thing a few years back.I bought a brand new 280 in the box after just rebuilding a drag powerhead.I lost a couple thousand dollars after I sold it for $7,000.Some people just dont want to take the chance again and have to rebuild right away so a new motor is usualy the reason behind it.
