I purchased a set of Mercury Kiekhaefer K-Plane 280S Trim Tabs Item# 120846587604 on Ebay. Seller was Carlos Diaz of Full Throttle Marine, Hialeah, Florida. I paid $US1400 for the planes and $US200 shipping from Hialeah to Paramount CA 90723-3921.
Moneys paid via PayPal all good. Then some problems with understanding the delivery address. Finally when it was obvious the planes had missed the container I contacted Carlos wanting information on the shipping company and a shipping/tracking number. Carlos didn't supply either the shippers name or a tracking number and the Planes never arrived in CA. Finally I complained to Ebay.
EBAY investigated and also found that Carlos couldn't/wouldn't supply information to allow Ebay to confirm shipping to CA or recover the planes.
EBAY HAS FULLY REFUNDED MY COSTS OF BOTH THE PURCHASE OF THE PLANES AND THE SHIPPING COSTS.:thumbsup::cheers:
A huge vote of thanks to Ebay. I don't know if they will be able to recover the money from Full Throttle Marine, but what a great guarantee and service they are now offering to help protect buyers using Ebay, from these scammers.
And a message for Carlos. Grow a back bone and become a man.:mad:
So guys please be wary of Full Throttle Marine, Hialeah, Florida, not good people to be doing business with.

If this guy Diaz will shaft someone for a relatively poultry $1600, what message does it send about his business. I note on a google search that Full Throttle Marine has a director of the company listed as one Carlos Diaz. You go warn you friend immediately, that is the purpose of threads such as this.;)

Ebay has all the information, it was them who made the connection between Diaz and Full Throttle Marine. Diaz had only told me that he worked in the marine industry.
Just real pleased I did the business through Ebay, all it ended up costing me was time on the computer. Stupid thing is I still need some K planes, I told Ebay that if possible could they locate the planes advertised and payed for, the refund was a last resort option.
Such is life.

When I got in this evening I was advised by email that this thread had seen some action including comments by Carlos Diaz from Full Throttle Marine. I am not sure what is going on but I certainly would like the opportunity to read and reply.:nonod:

There is more then it's share of Shady Buisness , and the Dade Co. area , and most certainly in Hialeah .
I spent the first thirty six years of my life in that area , and would only do buisness in person if I didn't already know who I was dealing with .
Funny , sense I've been in a relitivly smaller town for the last 14 years , I've seemed to have let my gaurd down after meeting so many good people and many of them right here on this board !
I've seen Scream and Fly , members go so far out of there way to make things right for people they have never even met in person , that have gotten the short end of the stick from someone in there area .

An update on where things are at:
Yes the planes arrived Wednesday a week ago. They were advertised as Mercury Kiekhaefer K-Plane 280S trim tabs(item # 120846587604).
In Carlos's last email to me he blamed Ebay for taking money out of his account, he blamed me for giving him a wrong address. He also told me that if there is any damage to the goods it will be the shippers fault.
I sure don't know what planet he is on.
I confirmed to him by email that I had given him the correct address in the first instant. Carlos told me the address supplied was incorrect. After consultation with my shipping agent I then copied a very terse email from my shipping agent to me telling him the address supplied was correct. He received this email well before he had his shipper collected the goods from him and yet he still managed to address it incorrectly. That is no mis-understanding that is a lack of due care and attention. Once he had sent the goods away I was unable to get a response from him to tell him that the goods had not arrived in CA. I believe Ebay also could not get a response from him and that is why they quite correctly deducted the money.
Finally and only after Ebay had deducted the money from his account did he supply a contact for his shipper so I could have my shipper track the goods down and retrieve them (at my cost).
Well surprisingly they arrived here in NZ without any obvious damage. He had put them on a timber frame and that was all..... He couldn't even manage to put the hydraulic pumps in cardboard cartons, so I was very surprised to find no apparent damage. Even the disconnected hoses and pump connections had no tape covering them to stop the ingress of dirt...... If I were sending these parts even within NZ they would have been completely wrapped up and that's not sending them half way around the world.
So ok, I collected them from the shipping agent. He had advertised them and I purchased them as Mercury Kiekhaefer K-Plane 280S trim tabs(item # 120846587604). They are definately not as advertised. Although the condition appears to be good the planes he sent measure 30 inches long from hinge to trailing edge, if they were 280S as advertised and purchased they would have measured 19 1/4 inches long from hinge to trailing edge, so absolutely totally useless for my application. As a marine dealer how could he have got such a basic thing as the product description of a marine product so wrong. I would have thought he should have been double careful given they were going offshore.
Here in NZ there is no market for these planes, we don't have 40ft+ go fast boats.
For the past week I have advertised them on a NZ wide similar auction site to Ebay to see if there is any interest where they could be on-sold. After a week of auction there were no "watchers" and no bidders so on-selling here in NZ is not an option. I have decided that cutting them down is not an option either because of the loss of corrosion protection.
I have an email in to a shipping company to get a quote on shipping them back to FL.
So as of right now, yes I have both the K Planes and have a refund from Ebay. Ebay as an independent arbitor also investigated Full Throttle Marine and decided that I had been scammed and took appropriate action.
I had asked Carlos for some paperwork (invoice) to ease its passege through NZ Customs. He refused till he had the money in his account. Smelling a rat I suggested that I would not pay till arrival and I could confirm they were as advertised. Funny thing is they weren't. :leaving:
I am happy to send them back to Full Throttle Marine provided I get my costs covered. They are the cartage costs and the costs of getting them here to NZ.
I don't think I can be any fairer than that. :rolleyes:

I took a look at where Joe lives. It don't exactly look like Cincinatti:D Not many plating shops around. He would probably have to ship them again somewhere for that type of work.
He does have expense involved here with shipping and customs, and when you consider travel and time involved, he's got a lot more invested than I would be willing to. At this point, I'd chuck em in the ocean, and move on, but that's just me. I don't exactly have a reputation for legendary patience:D
I've been in business 40+ years, and with a transaction like this, I would have NO expectation of getting paid.
Wrong item description
Wrong parts
Wrong address
Wrong packaging
And then "just return them", as if Joe is in West Palm Beach. Sorry, that crap don't play with my customers.

This kind of transaction just like transomstand gets to be more hassle then what is the best you can expect. Unfornately the shipping in this senerio. It would be one more thing on a shelf moved to the floor and somewhere in the garage. I just went through a similar purchase from a very well know dealer it was an electical part but I never opened and called Monday and got it Saturday no refund. Smokin you have really done a great job on your boat and this is another phefob. Hialea is a place one should go to or have someone go and check the product if possible. Rick

Like I said previously. I did note the item on ebay as 280S but i did put the dimensions of the trim tabs on my description on Ebay. At this point i know i made an error but Smoking Joe is making it seem like i sold him a Angler instead of a Yellow Fin. I Know there was issue with locating the shippment and not having a smooth transaction. You can simply cut the tab and have them re-powder coated. That is a fix as long as the tab doesnt hit any obstacles behind it or the motor once its fully turned to either side. I'm not here to fight with you as ive noted it was a error on Item description. If you cant make it work thats fine. Then simply get me a estimate on shipping to my shop. You havent lost anything on this deal but time. You were refunded your money back by Ebay in full.

I am still awaiting information on shipping back to the US. I will talk to a powder Coating guy about redoing the planes if they were to be cut. When I have all the information and alternatives I will put it up and see what Carlos would like done.
I did note the item on ebay as 280S but i did put the dimensions of the trim tabs on my description on Ebay.
I am fairly sure that the dimensions were not posted on your Ebay add description though you did say they came off a 25 foot boat. Your add also talked about it was a project of yours which was no longer going ahead and that you just wanted some money for the Christmas holidays. I am waiting for Ebay to get back to me with a copy of your Ebay listing. The actual listing is the only thing I have not got saved on my computer, as I hadn't expected Ebay to remove it.
Anyway as soon as I have all the information and options Carlos you and I can see what is best to be done.

I pulled the trigger 12th Jan, 2012 and sent payment straight away via Paypal.
Of interest whilst looking through my emails on this folder I noted the following. Top email is the reply, bottom email is my request for a detailed description.

Pumps work. Tabs work. The pumps are a pair. But the one u see with a can on it is because the plastic bowl had a minor pin hole. So instea of getting a new plastic can. I replaces it with a aluminum one I had in the shop. I am a marine shop in Miami Florida.

I have received a quote to return the K Planes to the US and I have forwarded these on to Carlos. My costs to date are $NZ742.67, (freight, GST tax, customs etc etc). I will advise of the result.

The result I suppose. I got a response from Carlos this evening. As I thought it is not cost effective to ship the K Planes back to the US so he has suggested he may be able to find some 280S planes, just the plates and send them to me and for me to use the balance of his gear. Or find a buyer for them here in NZ. :rolleyes:

I made a deal with someone who wanted to buy a bike off me. I knew the guy so, figured WTH.
It was for $2500 bucks and it was May he said he could pay it off by Thanksgiving. I said that was fine.
Well, evidently he didn't specify which Thanksgiving it would be paid off by because when Thanksgiving of
that year rolled around he had paid $500 bucks. I decided enough was enough.

Rather than ship them back, see if you can find some 280 plates. The mounting brackets, hardware pumps etc are all the same between the 3 models (180s, 280s, and 380s) Only difference is the plate themselves. I see them on OSO all the time for sale (just the plates) as guys will upgrade to longer or shorter lengths. Usually, there only a couple hundred bucks. Either that or you could even fab a set of plates. Just seems like shipping them back will waste more of your time and money...cut your losses and fix what you have. ;)
